Abstract

Case of domestic violence had increased every year, this is caused by people have a paradigm that domestic violence is privat domain. Even though, domestic violence be regulated by domestic violence elimination Act number 23 in 2004, but the victim often don’t recognize justice. In common law jurisdictions concentrate on judges, whose opinions contain masses of reasoning. In civil law jurisdictions, they focus more on the writings of jurists, both because their works are regarded as important evidence of what the law is, and because court judgements are much less elaborate in their ratiocinations, judge legal reasoning used Act priority, specially Act for Domestic Violence Elimination. Abstract

Land is one of the most major capitals in our life. Without it, sustainability of human existence is very impossible. Unfortunately, land problems in Indonesia have unique challenges compared to other countries. Many of kinds of challenges are in the form of the natural disasters. This paper is going to measure how well the principles of good governance has been incorporated in the Yogyakarta Special Region Land administration System generally by studying on the Merapi Disaster Mitigation, particularly in how  land planning for the Merapi Disaster’s victims is performed. The research methodology employs a combined research method, it means that fundamental principles in process and its output of both the doctrinal and non doctrinal approaches is synergized to based on the research’s activity unites. Configuration of  the land administration systems in achieving people prosperity has been affected by evolution of political, cultural, and legal awareness of local communities and central government policy. To conclude, incorporating a disaster response based land policy principles requires an integrated law and policy making system among parties through the implementation of good governance principle in the record of public participation voices and sustainable development interests. Notable reports illustrate that the good land governance incorporation encouraged and inspired land planning system to be more efficient and effective. Particularly in the natural disaster mitigation and reconstruction, incorporating good land governance principles furthermore encourages land policy makers to achieve the responsive land management in line with social demands and sustainable development programs.

Abstract

The Communal Right to Land (Hak Ulayat), both as the economic source and communal identity, should be empowered and be protected. This research studies the regulation of the utilization of Tanah Ulayat for the interest of investment and finds the root of its conflict in West Sumatera.  The result of the research concludes that there is no both horizontal and vertical synchronization in regulating of Tanah Ulayat. The regulations that have been enacted by DPRD and governor of West Sumatera are not in line with the Adat and Custom of Adat Community. Those regulations are also far from an ideal regulation and Syariah (Islamic Law), while the root of the conflict is the inconsistence between the regulation of Tanah Ulayat and its implementation which ignore the contract

Abstract

Indonesia is no longer an authoritarian country, and no longer centralized government. Decentralization processes since 1999 has changed local democratization in a wider participation. Nevertheless, the culture of openness and incorrupt have been far from the more ideal situation. Bribery, corruption and unresponsive public services have been continuously and more systematic taking place. In that context, the Government of Indonesia enacted Law No. 14 of 2008 concerning Public Information Openness (Keterbukaan Informasi Publik or called PIO Law), which is implemented since 30 April 2010. The PIO law is believed to contribute to the better decentralization processes and economic-political democratization at local level. Nevertheless, although right to access information was guaranteed by law, but it has been applied in limited process. Such situation actually gives clear evidence that decentralized Indonesia should be questioned, especially in terms of how the right to access information has been applied in a meaningful way after the enactment PIO Law in 2008 and, what the dominant problems in implementing right to access information are. This article will elaborate the norms and practices of PIO Law by using the rule of law point of view.

Abstract

Contract of work is an agreement made between the government of the Republic of Indonesia with foreign companies, and or joint ventures between foreign companies with domestic legal entities to carry out exploration and exploitation in general mining or oil and gas out of the earth, in the time period agreed by both parties. One of the foreign companies in cooperation with the Indonesian government in this field is PT Newmont Nusa Tenggara which form the contract of work in the field of utilization and development of mining potential in Indonesia. However, Act No. 25 of 2007 on Investment, Chapter IV of Form and Position Enterprises in Article 5, paragraph 2 requires that the foreign investment shall be in the form of a limited liability company based on Indonesian law and domiciled in the territory of the Republic of Indonesia, unless specified otherwise by law. Therefore, a contract of work is often regarded as a national contract by many parties. Others suggested that such contract which involves foreign investment transaction is sui generis, or in other words a quasi-public international contract. This paper will discuss the foreign elements of the contract and conclude that the contract of work can be categorized as an international contract.

Abstract

Restorative justice has been developing broadly in many countries as a new paradigm in the criminal law field.  Following the necessity and global trend, Indonesia has made an effort to replace the current Juvenile Court Act (JCA) with the new one, called Juvenile Criminal Justice System Act (JCJSA), which utilizes diversion as a restorative justice program for juvenile delinquent which took into effect since July 2014. As a new paradigm, restorative justice has been criticized sporadically. One of the critics is how to balance public interest and individual interest when they are in conflict regarding the restorative justice settlement that reached by the victim and offender. The contention between the proponent and opponent of the restorative justice movement on this issue is remains unsolved up to present. This issue is also possible may be arise when the Indonesian government enforces JCJSA. As a Muslim-majority country, Indonesia has an opportunity to resolve the contention by offering Islamic Criminal Law (jinayat) as an approach method since restorative justice values exist also in Islamic criminal law. There are at least two notions why Islamic criminal law could relax the contention. Firstly, historically Islamic law ever existed in Indonesia. Secondly, restorative justice values exist in Islamic Criminal Law. This paper will try to portray restorative justice in Islamic criminal law point of view in order to mollify the contention.

Abstract

After the Amendment of the 1945 Constitution of The Republic of Indonesia, The Judicial Power has become the most fundamentally power and also as a part of the axis of power which its function is to enforce justice. According to the Amendment of the 1945 Constitution of The Republic of Indonesia, the judicial power in the structure of state power, is still placed at the power that is free from intervention or influence from other power in exercising its authority. In the structure of state power, after the Amendment of the 1945 Constitution of The Republic of Indonesia, the judicial power shall be implemented by a Supreme Court and judicial bodies underneath it in the form of public courts, religious affairs courts, military tribunals, and state administrative courts, and by a Constitutional Court. The Amendment of the 1945 Constitution of The Republic of Indonesia, also spawned a new institution, which its function is relating to judicial power, namely an independent Judicial Commission which shall possess the authority to propose candidates for appointment as justices of the Supreme Court and shall possess further authority to maintain and ensure the honour, dignity and behaviour of judges.

Abstract

Processes and Production Methods (PPMs) are the subject of one of the most complicated controversies in the debate over international trade and protection of the environment and human health.  The issue of PPMs actually is not prohibited under the WTO system. There are some cases which may become evident to prove that PPMs is permisible in WTO system. However, PPMs for some rasons can be used as a tool of disguise protectionism by the developed countries. Unfortunately, a developing country finds difficulty to challenge it.  The article emphasizes in   a weighty examination of the two  issues , namely : (i)What are the justifications of process and production method (PPMs) to implement  in international trade? (ii) What are the legal implication of PPMs in international trade to the protection of the environment and the human health ? The research method is qualitative and the approach of the research is normative. The research finds that the implementation of PPMs to some extend are justifiable in international trade to the extent that comply with the provisions of the General Agreement on Tariffs and Trade (GATT),  the Agreement on Sanitary and Phytosanitary Measures (SPS), and  the Agreement on Technical Barriers to Trade (TBT) Agreement.

Abstract

This research intended to know whether murabahah financing contract on the sharia banking has fullfill to sharia principles in Islamic law provisions. This research is a normative or doctrinal research. This research is the kind of doctrinal or normative legal using approach of law (statute approach) and conseptual approach so it’s using the secondary dates sources such as primary,secondary and tertiary legal materials. Dates was collected with library research and analyzed by deductive logic. According of research result and analysis that the murabahah financing contract on the Sharia Mandiri Banking in Yogyakarta isn’t suitable sharia principles accordance in the Islamic Law because some requirements in the contract implementation hasn’t fullfill to sharia principles so it founded gharar, riba and zhalim. So, this is inline with sharia principles accordance in the Al-Quran, Al-Hadits and Fatwa Council of Sharia National Number 04/DSN-MUI/IV/2000 on Murabahah and also Law Number 21 Of 2008 on Sharia Banking.

Abstract

Tujuan penelitian ini adalah untuk mengidentifikasi dan mengevaluasi berbagai bentuk kebijakan pemerintah daerah serta mengevaluasi kondisi eksisting berbagai  program TJSP di DIY dan Provinsi Jawa Tengah yang telah dilaksanakan. Untuk menjawab tujuan tersebut, maka metode yang digunakan adalah Pada tahun pertama, penelitian ini dilakukan dengan metode penelitian yuridis normatif dengan pendekatan perundang undangan (statute approach) (Marzuki, 2005: 137-139); dan penelitian yuridis empiris (sosiologis). yaitu mengkaji dan mengevaluasiberbagai bentuk kebijakan daerah serta program pelaksanaan TJSP di Daerah Istimewa Yogyakarta dan Provinsi Jawa Tengah. Berdasarkan hasil dan pembahasan dapat disimpulkan bahwa: Pertama, Kebijakan TJSP oleh pemerintah daerah terutama di DIY dan Jatenag secara umum masih sangat lemah,  dimana untuk DIY dalam bentuk Peraturan Gubernur sedangkan Jawa Tengah menggunakan Surat Keputusan Gubernur.  Kedua, untuk Program TJSP yang dilakukan oleh perusahaan selama ini belum mengetahui kalau pemerintah telah mengeluarkan kebijakan TJSP. Sehingga perusahaan dalam melakukan TJSP selama ini hanya sebatas inisiatif sendiri dan walapun secara tidak langsung sudah bekerjasama dengan pemerintah dalam melaksanakan TJSP. Perusahaan secara umum akan mendukung kebijakan Daerah mengenai TJSP dalam bentuk Perda. Namun ketentuannya harus mempertimbangkan kepentingan situasi dan kondisi yang dihadapai perusahaan.
